1. Interpretation
- “Eddie AI”(also referred to as “Eddie”, “we”, “our” or “us”) is an AI-powered photo enhancement platform owned and operated by Capture Video Productions (Pty) Ltd (“CVP”).

- When we say “you” or “your”, we mean both you as an individual and any entity, agency or firm you are authorised to represent. When we say “Eddie AI”, “we”, “our” or “us”, we refer to Eddie AI and its parent company, CVP.
- Words such as “include” and “including” are not words of limitation, and where anything is within our discretion, we mean our sole discretion.
- When we refer to our services and products, we refer to the Eddie AI platform, its AI-powered photo enhancement features, generative editing tools (sky replacement, object removal, virtual staging), web editor, export tools, subscription plans, credit systems, and any other related services or products we may offer.
- By creating an Eddie AI account or using our services and products, you agree to follow the rules outlined here. Please read them carefully and ensure you understand your rights and obligations.
2. General
- You undertake to keep your account information (including a current email address) up to date. You are responsible for providing true, accurate and complete information and for verifying the accuracy of any information that you use from our platform.
- We are constantly improving our services and products. For new or updated features, there may be additional terms and conditions. We will notify you of any such terms before you begin using those features.
- We own all intellectual property in Eddie AI unless otherwise stated, excluding content owned by you or third parties. This includes rights in the design, compilation, look and feel of our platform, as well as all copyrighted works, trademarks, designs, inventions and other intellectual property. You agree not to copy, distribute, modify or make derivative works of any of our content or use any of our intellectual property in any way not expressly permitted by us.
- Eddie AI is a South African product and we first and foremost comply with South African law. While we believe our services are reasonable and lawful across jurisdictions we are aware of, we will always verify compliance before extending services to new jurisdictions.
- Amounts not paid when due under this agreement will accrue interest at prime plus 5%, compounded monthly. In addition to all other available rights and remedies, Eddie AI reserves the right to suspend or restrict access to your account if you fail to make timely payments.
- All payments received by Eddie AI shall be allocated first to costs, then to interest, then to the capital balance outstanding.
- No indulgence which any party may grant to the other shall constitute a waiver of any of the rights of the granting party.
- No addition to, or variation of, these terms shall be of force or effect unless reduced to writing and acknowledged by Eddie AI.
3. Service Description & Use
Our Services
Eddie AI provides an AI-powered platform for enhancing and editing real estate photography. Our services include, but are not limited to:
- Core AI Enhancement— automated white balance, exposure correction, shadow and highlight recovery, perspective correction and noise reduction.
- Advanced Generative Edits— AI-powered sky replacement, object removal, virtual staging and other generative modifications, available on a credit-based system.
- Web Editor— an in-browser canvas editor for manual adjustments and fine-tuning.
- Batch Processing & Export— the ability to process multiple images and export them individually or as a batch ZIP file.
Your Responsibilities
- You must ensure that you have the rights, licences or permissions necessary to upload any photographs or images to our platform.
- You are responsible for ensuring that the content you upload does not infringe on the intellectual property, privacy or other rights of any third party.
- You must not upload content that is unlawful, offensive, defamatory or otherwise objectionable.
- Enhanced and edited images are provided for your use in accordance with your subscription plan. Eddie AI does not claim ownership of the photographs you upload.
Image Processing & Storage
- Uploaded images are stored securely and processed using our AI infrastructure. Processed images are made available to you via your account dashboard.
- Eddie AI cannot be held liable for loss or damage to image files after they have been made available to you for download. We recommend maintaining your own backups of original files.
- We reserve the right to use anonymised, non-identifiable data derived from platform usage (not your specific images) for the purpose of improving our AI models and services, unless you explicitly opt out.
4. Subscriptions & Payment
- Eddie AI offers subscription plans (Standard and Pro) as well as one-time credit top-up packs. Current pricing is displayed on our platform and is denominated in South African Rand (ZAR).
- Upon signing up, you receive a 3-day free trial and 50 bonus credits. No credit card is required to start a trial.
- Subscription fees are billed monthly and are payable in advance. Payments are processed securely via Stripe.
- Eddie AI may adjust its pricing from time to time with not less than 30 days' written notice. If you do not agree with a price increase, you may cancel your subscription before the new pricing takes effect.
- Fees exclude value-added tax (VAT), which you must pay at the applicable rate. You agree to receive electronic invoices and receipts via email.
- All payments must be made without deduction, set-off or withholding. Should you fail to pay any amount due by the due date, we may:
- Charge interest on the overdue amount at the prime overdraft rate offered by our bankers.
- Suspend or restrict access to our services until payment is received.
- Credits purchased through top-up packs do not expire as long as your account remains active. Credits are non-refundable and non-transferable.
- No refunds will be issued for partial months of service or unused credits upon cancellation.
5. Data Use & Privacy
- Eddie AI uses your data to provide and improve our services. Our Privacy Policy is an important part of these terms and describes in detail how we handle personal data.
- We respect your privacy and take data protection seriously. In addition to these terms, our Privacy Policy sets out how we process the personal data you share with us, such as your name, email address and billing details.
- When your personal information enters our systems, we do not own that data. Through your explicit consent, we are permitted to process such data to provide and improve our services, to communicate with you, and to send you information we believe may be relevant to your use of our platform.
- We may anonymise your personal information for statistical purposes, including service improvement, trend analysis and the development of new features. Such anonymised data will not identify you personally.
- Where we become aware of unauthorised access to personal data, we will notify you and provide information about the incident as required by applicable law. We will immediately take all reasonable steps to mitigate the effects and minimise any resulting damage.
- Third-party services (including Stripe, Supabase and RunPod) are subject to their own terms, conditions and privacy policies. We encourage you to review them. Eddie AI takes all reasonable steps to ensure the integrity and security of third-party services we integrate with, but cannot accept liability for those services beyond our reasonable control.
6. Maintenance, Downtime & Data Loss
- We strive to maintain the availability of our platform around the clock and to provide a level of support reasonably expected for a service of this nature. Where planned maintenance is required, we will attempt to notify you in advance. For unplanned downtime, we will attend to resolution with appropriate urgency.
- The nature of internet-based services means occasional interruptions may occur. You acknowledge that we cannot accept responsibility for downtime caused by factors outside our reasonable control.
- Data loss is an unavoidable risk with any technology. You are responsible for maintaining copies of your original images. We take all reasonable steps to protect against data loss and ensure business continuity through regular backups.
- We regularly release updates, modifications and new features. Where changes are material, we will endeavour to notify you in advance (for example, by email or an in-app notice).
7. Acceptable Use
- You agree to use Eddie AI only for lawful business purposes and in line with the guidance and instructions we provide.
- We welcome your feedback and may use it without restriction to improve our services. We will not share your feedback publicly without your consent.
- Occasionally we may offer services at no charge or at a reduced price — for example, a beta feature or a trial account. Due to the nature of such offerings, you use them at your own risk.
- You must never:
- Undermine the security or integrity of our computing systems or networks.
- Use our services in any way that might impair functionality or interfere with other users' access.
- Access any system without permission.
- Upload content that contains viruses, malware or other malicious code.
- Share content that is offensive, unlawful, or that infringes on the rights of others.
- Modify, copy, adapt, reproduce, disassemble, decompile, reverse engineer or extract the source code of any part of our platform.
- Resell, lease or provide our services in any way not expressly permitted.
- Repackage, resell or sublicense any outputs, data or AI models accessed through our platform.
- Commit fraud or other illegal acts through our services.
- Act in a manner that is abusive or disrespectful to Eddie AI and its employees, partners or users.
- Bring Eddie AI or CVP into disrepute or negatively affect their reputation.
Should you engage in any of the above, we reserve the right to suspend or terminate your account immediately and, where applicable, to claim damages.
8. Duration & Termination
- Your agreement with Eddie AI commences on the date you create your account and accept these terms.
- You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period.
- We may terminate or suspend your account with 30 days' written notice. We may also suspend or terminate your account immediately if:
- You breach any of these terms and do not remedy the breach within 7 days after receiving notice.
- You breach any of these terms and the breach cannot be remedied.
- You fail to pay your account.
- You or your business become insolvent or subject to any similar insolvency event.
- No refund is due if you cancel your subscription or if we terminate it in accordance with this clause.
- Upon termination, we will make your uploaded images available for download for a period of 30 days, after which they may be permanently deleted.
9. Liability & Indemnity
- You indemnify us against all losses, costs (including legal costs), expenses, demands or liability that we incur arising out of or in connection with a third-party claim relating to your use of our services (except insofar as we are at fault).
- We accept no liability for any loss or damage arising from the use of our services, except where required by law. In the unlikely event we are unable to deliver services as described, liability shall be limited to the total subscription fees paid by you in the preceding 12 months.
- Our services are provided on an “as is” basis. Subject to Sections 48 and 49 of the South African Consumer Protection Act (where applicable), we disclaim all warranties, express or implied.
- We shall not be liable for any indirect, consequential, incidental, punitive, exemplary or special loss, damage or expense, including but not limited to loss of revenue, profit, goodwill, customers, anticipated savings, or damage to reputation.
- For loss or corruption of your uploaded images or personal information, our liability is limited to taking reasonable steps to recover such data from our available backup systems.
10. Security
- We have invested in technical, physical and administrative safeguards to protect your data in compliance with South Africa's data privacy laws (POPIA). While we have taken reasonable steps, no method of electronic storage is completely secure and we cannot guarantee absolute security.
- We may introduce additional security features (such as two-factor authentication) from time to time. Where such features are optional, you are responsible for any consequences of choosing not to use them.
- You must keep your Eddie AI account credentials secure and not allow any other person to use them. If you become aware of any unauthorised access to your account, you must notify us immediately.
11. Jurisdiction & Dispute Resolution
- Most disputes can be resolved quickly by contacting Eddie AI support. If we are unable to resolve a dispute informally within 14 working days (or such extended period as mutually agreed), the parties agree to pursue alternative dispute resolution — first mediation, then arbitration, and if necessary, referral to a South African court with competent jurisdiction.
- You consent to the jurisdiction of the magistrate's court in respect of any proceedings brought against you, provided that Eddie AI retains the right to bring proceedings in the High Court where such proceedings would otherwise fall outside the magistrate's court's jurisdiction.
- Should Eddie AI be required to institute legal action for any purpose arising from this agreement, you shall be liable for legal costs on the scale as between attorney and own client, including tracing fees and collection commission where applicable.
- The cost of resolving disputes through alternative dispute resolution shall be borne equally by the parties.
12. General Provisions
- Eddie AI is a technology platform and does not provide professional photography, legal, tax or accounting advice. While we provide information useful for using our services, this should not be treated as a substitute for professional advice.
- We are not liable for any failure or delay in performance arising from circumstances beyond our reasonable control (force majeure), including but not limited to natural disasters, power outages, internet disruptions or government actions.
- Any notice you send to Eddie AI must be directed to support@capturevideos.co.za. Notices from us will be sent to the email address associated with your account.
- We fully comply with applicable consumer protection laws. In jurisdictions where non-excludable consumer guarantees exist, those guarantees still apply — these terms do not exclude or restrict them.
- We may block your access, suspend your account, or refuse to process a payment if we reasonably believe there is a legal, regulatory or fraud risk associated with your account or transactions.
- Nothing in these terms constitutes a partnership, joint venture, employment or agency relationship between you and Eddie AI. You may not assign or cede your rights and duties as an account holder. Eddie AI may assign these terms to another entity as it deems appropriate.
- We may update these terms from time to time. The latest version will always be available on our website. Material changes will be communicated with at least 30 days' notice where possible. If you find a modified term unacceptable, you may cancel your subscription in accordance with clause 8.
- If any part of these terms is found to be invalid or unenforceable, it shall be severed and the remaining terms shall continue in full force and effect.
13. POPIA Compliance
By subscribing to our services, you consent to Eddie AI (and its parent company, Capture Video Productions (Pty) Ltd) processing your personal information for the purpose of fulfilling our obligations under this agreement.
